• In a court filed document, Elliott and Ron Taylor allege the following, “The City of Napa subsequently determined that the transfer of the cannabis permit was not proper and determined that once Plaintiff 2nd Street withdrew permission for operation of the cannabis dispensary by ST6, the permit was withdrawn by the City of Napa.” Please provide the specific notice or communication that provided Elliott and Ron Taylor with the information referenced in the court filed document. Additionally, please provide a formal statement from the City of Napa on the whether the application Cannabis Establishment Clearance MMD18-0001 was or was not improperly transferred.
• Please provide all notices or communications between the dates of 01/01/2018 to present, where Marc Mazer, Rob Jaret, Elliott Taylor, Ron Taylor, Steven Kay, Jason Vedadi, Steve White,and/or Paul Goetz were provided with communications between Colton Callahan and any employee of the City of Napa. 

• Please provide ALL communications between the dates of 01/01/2018 to present, (sent and received) referring or relating to the cannabis establishment clearance MMD18-0009.

Greetings Mr. Callahan,

The City of Napa is in receipt of your November 15, 2019 public records request. The City initially responded to your request on November 20, 2019 and provided you with responsive records. The City also sent you a status update regarding the remaining portion of your request on December 23, 2019, which stated another update would be provided during the week of January 20, 2020.

City staff has identified the remaining responsive records related to your request, which contains email correspondence. You may view the responsive records by clicking on the link below.

Please note that personal information has been redacted pursuant to Government Code Section 6255 (a) that states the agency shall justify withholding any record by demonstrating that the record in question is exempt under express provisions of this chapter or that on the facts of the particular case the public interest served by not disclosing the record clearly outweighs the public interest served by disclosure of the record.

The City has determined that certain responsive correspondence related to your request is exempt from disclosure under applicable provisions of the California Public Records Act, because it is communication between City staff and attorneys for the City which is subject to the attorney-client privilege. (Government Code 6254 subd. (k).) Those communications will not be produced.

Our staff is currently working on reviewing additional email correspondence for potential exemptions. I will keep you updated on the City’s efforts regarding this review process and I will provide you with an update during the week of February 10, 2020, if not sooner, to inform you if the City has any remaining responsive records.

Greetings Mr. Callahan:

I am providing you with an update regarding your November 15, 2019 Public Records Act request, which the City initially responded to you on November 20, 2019 via our NextRequest portal.

Our I.T. Department has completed the network email search and a voluminous amount of potentially responsive records have been identified.  City staff believes that certain material may be exempt from disclosure under applicable provisions of the California Public Records Act. Certain of these materials will need to be more fully reviewed, and any relevant exempted material removed.  Our staff is currently working on reviewing these materials. The City Clerk’s Office will make public records available as soon as they are determined to be subject to disclosure, and I will update you on progress no later than the week of January 20, 2020.

Good Afternoon Mr. Callahan,

The City of Napa is in receipt of your November 15, 2019 public records request. City staff has identified responsive records to your request. You may view the responsive records by clicking on the link below.

These responsive records include a Public Records Act request submitted by Marc Mazer on January 3, 2019 along with the City’s responses sent on both January 14, 2019 and January 15, 2019. Other responsive records include copies of clearance certificates, letters, and notices from our Community Development Department. Please note that the City does not possess any responsive records related to “the Application Fee receipt for Cannabis Establishment Clearance MMD18-0009.”

The remaining portions of your request regarding “all communications between the dates of 01/01/2018 to present…” identify documents in the City’s possession that staff anticipates will generate a large volume of records, some of which may be exempt under the California Records Act (CPRA). Assembling and reviewing these records will require the City Clerk’s Office to coordinate with our I.T. Department to conduct a citywide network search to extract responsive emails.

City staff is in the process of conducting a network wide email search for potentially responsive documents and additional time will be required to review these materials. I anticipate that we will have these responsive records available for production within the next month, and we will provide you with an update during the week of December 30, 2019, if not sooner.
