Good Afternoon Amanda,

The City of Napa is in receipt of your November 8, 2019 Public Records Act request. On November 15, 2019, the City invoked an extension of time provided by California Government Code Section 6253(c) to respond to your request by December 2, 2019.

City staff has identified the following responsive records to your request as described below. You may review the responsive records by clicking on the link below.

1) All Trip and Fall claims the City resolved over the past five years. Please include the address of the Trip and Fall, claimant's name, any financial pay out or settlement paid to claimant. Please annotate if the Trip and Fall was from Concrete Sidewalk Displacement or a pot hole. Additional please indicate whether the Trip and Fall address was listed as a hazard or otherwise identified on the City's list (established list of sidewalk identified as in need of repair/replacement known as Concrete Sidewalk Displacement) at the time of the Trip and Fall.

Attached is an existing list containing all Trip and Fall claims over the past five years showing the incident date, received date, claimant’s name, claim number, litigation, status, amount paid to claimant, and closed date. All trip and fall claims are believed to be from displacement and not from “potholes.” The City is not required to create documents to respond to your request and thus has not added address information or annotated the list in any way.

2) Please provide the City's current Concrete Sidewalk Displacement list. Please include yardage of each item and any estimates the City has to repair the displaced sidewalk.

Attached is a copy of the Concrete Sidewalk Displacement List. Please note that some of the older data contains information related to yardages and other estimated quantities.

3) Please include any list of claims for damage related to potholes in the last five years, type of claim, an itemized amount of claims paid listed by street, pending claims, and list of potholes in need of repair.

Attached is a list of claims related to potholes over the last five years. Please note that the City does not possess any responsive records regarding a list of potholes in need of repair.

4) Please provide any pending Trip and Fall claims, claimant's name, address location of Trip and Fall and amount of financial claim citizen/s is seeking.

Please refer to the Trip and Fall Claims list provided in response to Item #1 noted above.

Good Afternoon Amanda, 

The City of Napa is in receipt of your November 8, 2019 Public Records request. This request will require the City to search for requested records from multiple departments and from locations separate from the City Clerk’s Office. For these reasons, the City is invoking the extension of time provided by California Government Code Section 6253(c).  Accordingly, I anticipate that we will be able to more fully respond to your request no later than Monday, December 2, 2019, if not sooner.
