Dear City of Napa Public Records Staff:

This is a request under the California Public Records Act (“PRA”) for the following-described categories of information, documents, and/or materials (i.e., “writings” as broadly defined under Evid. Code section 250, thus including electronically-stored information, and any and all communications consisting or comprised of text messages, emails, audio/visual recordings, etc.), received or prepared by the City of Napa ("City") (including its staff, employees, agents, officials, departments, consultants, contractors, etc.), as follows:

1) All writings received or prepared by the CIty from January 1, 2015 through the date of the City's response(s) to this PRA request, that comprise, consist of, relate to, or reference any development- or land use-related applications, submittals, forms, communications, or other requests for entitlements, approvals, permits, grants, subsidies, waivers, or funding by, involving, or on behalf of the following entities or individuals (including any of such entities’/individuals’ agents, representatives, departments, divisions, employees, officials, staff, consultants, counsel, partners, affiliates, parent companies, subsidiaries, sponsors, joint-venturers, etc.):

2)  All writings received or prepared by the City from January 1, 2015 through the date of the City's response(s) to this PRA request, that comprise, consist of, relate to, or reference any development- or land use-related applications, submittals, or other requests involving, for, or relating to any proposed development project(s) or improvement(s) at or of the parcels with the street addresses 3700, 3710, and 3720 Valle Verde Drive, Napa, CA (APNs 038-170-042, -043, and -046), or any portions thereof, located just north of the intersection of Firefly Drive and Valle Verde Drive, including without limitation the proposed project called, or known or referred to as, “The Valle Verde and Heritage House Continuum of Care” project – which is also sometimes referred to as having a “Valle Verde Apartments” component, and a “Heritage House” component.

As noted, the writings sought by the above PRA requests specifically include, for example and without limitation, any and all responsive communications, memos, reports, studies, or other dialogue - whether in draft or final form (thus, including for example drafts of reports or portions thereof, administrative drafts of any EIRs or portions thereof, drafts of responses to public comments on any draft EIRs, etc.) - as well as any and all responsive, electronically-stored or -retained writings kept in audio/video media form, and any and all texts, emails, etc. between the City (including its consultants, agents, representatives, etc. as noted above), and the above-referenced applicant/s (including its/their consultants, agents, representatives, etc. as noted above).

Greetings Mr. Muller:

I am providing you with another update regarding your November 12, 2019 Public Records Act request.

As stated in the City’s response dated January 15, 2020, our network email search resulted in a voluminous amount of potentially responsive records. Our staff is currently working on reviewing thousands of emails and still examining these materials for potential exemptions.

I anticipate that we will have a portion of these responsive records available for production within three-four weeks, and we will provide you with an update during the week of February 24, 2020, if not sooner.

In further response to your November 12, 2019 request for records, which was further refined on November 18, 2019, as outlined below, the City responds as follows:

 

1) All writings received or prepared by the City from January 1, 2015 through the date of the City's response(s) to this PRA request, that comprise, consist of, relate to, or reference the proposed development project at the parcels with the street addresses 3700, 3710, and 3720 Valle Verde Drive, Napa, CA (APNs 038-170-042, -043, and -046) known or referred to as, “The Valle Verde and Heritage House Continuum of Care” project – which is also sometimes referred to as having a “Valle Verde Apartments” component, and a “Heritage House” component. - Focus should be on materials and communications not readily available to the public, i.e. memos, letters, emails, text messages, etc.

 

CITY RESPONSE: staff has identified responsive text messages have been identified and provided. You may view the responsive records by clicking on the link below. Please note that personal information on some records has been redacted (such as phone numbers) pursuant to Government Code Section 6255 (a) that states the agency shall justify withholding any record by demonstrating that the record in question is exempt under express provisions of this chapter or that on the facts of the particular case the public interest served by not disclosing the record clearly outweighs the public interest served by disclosure of the record.

 

The network email search has been completed and a voluminous amount of potentially responsive records have been identified.  City staff believes that certain material may be exempt from disclosure under applicable provisions of the California Public Records Act. Certain of these materials will need to be more fully reviewed, and any relevant exempted material removed.  The City is gathering and reviewing these materials. We will make public records available as soon as they are determined to be subject to disclosure, and will update you on progress no later than the week of January 13, 2020.

In addition, you may make an appointment with our office to view the full, active, Heritage House/Valle Verde planning file (PL17-0114), at City Hall during normal business hours 8am to 5pm Mon-Fri.

2) For the three parcels above, provide all applicable title information, to include: utility/sewer easements, deeds of trust, deed restrictions.

CITY RESPONSE: Responsive records in the City’s possession have been identified and provided. You may view the responsive records by clicking on the link below.

The Napa County Recorder/County Clerk maintains all official records relating to real property in Napa County to include deeds. You can contact the County Recorder at 707-253-4105 or via email at recorder-clerk@countyofnapa.org.

Additionally, you may wish to reach out to the Napa Sanitation District who provide all wastewater collection, treatment and disposal to the residents and business in the City of Napa. You can contact NapaSan via phone at 707-258-6000 or email at info@napasan.com

3) Locate the planning file for the Sunrise Napa Assisted Living Facility and advise the volume of records contained in the file for potential viewing and/or production.

CITY RESPONSE: The City of Napa does not have a physical file in response to this request. A search was also conducted under the name of “Valle Verde Residential Care.” Electronic records regarding project have been identified and provided. You may view the responsive records by clicking on the link below.

4) Provide Conditions of Approval for both the Heritage House/Valle Verde Project, and the Sunrise Napa Assisted Living Facility Project, specifically relating to the use of the property.

CITY RESPONSE: Electronic responsive records in the City’s possession for the Sunrise Napa Assisted Living Facility Project (also identified formally as Valle Verde Residential Care) have been identified and provided. You may view the responsive records by clicking on the link below.
