Dear Mr. Flaherty:  

The City has received your request for records dated January 23, 2020, which is outlined below for reference. 

  • All correspondence to or from any City agency and a member of the public or another City agency regarding the "Anderson Residence" project at 16 Pascale Place / APN 045.411.020 (Planning Division designation PL19-0056) from August 12, 2019 to present.
  • All documents or correspondence related to any environmental testing or remediation at APN 045.411.020 performed August 2019 to present.

In regard to Request #1, the City does possess responsive records. The City is providing readily available responsive records for Request #1 in electronic format including a staff memorandum regarding conditions of approval dated August 28, 2019 and a letter dated September 16, 2019 from Steve Hammond. The City has also identified and is searching its email for additional responsive correspondence. Staff anticipates this search will generate a large volume of records, some of which may be exempt under the California Government Code 6254 subd. (k), which exempts from disclosure all records exempt from disclosure under federal or state law or applicable provisions of the Evidence Code related to the attorney-client privilege. 

Assembling and reviewing these records will require the City Clerk’s Office to coordinate with our I.T. Department to conduct a citywide network search to extract responsive emails. City staff is in the process of conducting a network wide email search for potentially responsive documents and additional time will be required to review these materials. I anticipate that we will have the remaining responsive records available within the next 4 weeks, and we will provide you with an update the week of March 2, 2020, if not sooner.

With regard to Request #2, the property number listed is for 16 Pascale Place. City staff does not possess any responsive records related to any environmental testing or remediation at APN 045.411.020 performed August 2019 to present.
